Velvet Sole is operated by its registered business entity. All records required to be maintained pursuant to 18 U.S.C. § 2257 and 28 C.F.R. Part 75 with respect to visual depictions of actual sexually explicit conduct are kept by the Custodian of Records at the address below. Velvet Sole is an online platform that hosts content uploaded by independent creators. All creators who upload content depicting sexually explicit conduct are required to certify, prior to uploading, that all performers depicted in such content are 18 years of age or older, that they possess written documentation verifying the age and identity of all performers, and that they are the primary producer of such content as defined under 18 U.S.C. § 2257. By uploading content to Velvet Sole, creators represent and warrant compliance with these requirements.
With respect to content uploaded by third-party creators, Velvet Sole is a secondary producer as defined under 18 U.S.C. § 2257 and is not the primary producer of such content. Velvet Sole requires all primary producers (creators) to maintain the required records and to provide certification of compliance as a condition of using the platform.
Some content on Velvet Sole does not depict sexually explicit conduct as defined under 18 U.S.C. § 2257 and is therefore exempt from the record-keeping requirements of that statute.
